General information

We are aware how important it is to you how we use and share your personal information. As a User of our application, we appreciate the trust you place in us to treat your privacy with due rigor and caution. This document details the Privacy and Cookies Policy (the 'Privacy Policies') that is in force at any time, it is your obligation as a User to review said text periodically to verify that you are satisfied with it. These Privacy Policies, together with the Terms and Conditions, and the Legal Notice of the application of MyOwnTree.org  as well as the Legal Notice and Privacy Policies of the website https://www.myowntree.org (hereinafter, the 'Application'), constitute the Terms and Conditions (hereinafter, the 'Terms and Conditions') of the services offered by MyOwnTree NGO to its Users through the application. From the moment access the application, you accept and consent to the practices described in this Privacy Policy.

 

Treatment of personal data

The MyOwnTree.org application is property of MyOwnTree NGO, with registered office in Romania and email address: contact[at]myowntree.org. MyOwnTree.org non-commercial purpose is the protection of existing forests and Carbon footprint offsetting certification through the Carbon sequestering produced by said forests through the use of the application and other digital tools. In compliance with the provisions of the General Data Protection Regulation (hereinafter, the 'GDPR'), we inform you that the personal information you provide us through the application at the time of your registration, when making inquiries or when contracting additional products or services within the application, will be included in the Users file, owned by MyOwnTree NGO. Based on the features of the application that you use, the processing of the data provided can be done exclusively for the following purposes:

a) The development, fulfillment, improvement, maintenance and execution of the contracted/ acquired services, the development of services linked to those that you decide to access and to protect MyOwnTree.org and our Users (for example, in the case of unauthorized access reports) to your account;

b) Address the requests that you put forward;

c) Provide you with information about the MyOwnTree.org services, including, if you have requested, the sending of transactional communication by email or any other equivalent electronic communication or through social networks in relation to these products. You can unsubscribe to any of the subscription services at any time, through our application, accessing "Unsubscribe" button from all email communications.

In the event that, you contract services, or personal data from a third party, you are responsible for having sufficiently informed said party and have obtained their express consent for the aforementioned contribution.

MyOwnTree NGO is responsible for the individual file and undertakes not to assign the data to a different purpose for which it was collected or to assign any file illegitimately to third parties, requesting through forms only the necessary data to be able to comply with the indicated purposes. It also undertakes to treat your data confidentially and to apply the security measures of a technical and/ or organizational nature necessary to avoid its treatment or unauthorized access as established by the current regulations on data protection.

If necessary, and in order to comply with the aforementioned purposes, MyOwnTree NGO may communicate or assign the information provided to its suppliers, financial entities, anti-fraud agencies, suppliers of technological services, logistics, transportation and delivery to client and/ or analysis of the transaction that are made through the application in order to offer users sufficient guarantees in commercial operations etc. By filling in your data through any of the forms available in the application, you expressly authorize us to process and assign this information. Your authorization includes those cases in which, for efficiency or for the service's own needs (for example, the allocation of forest plots outside the European Union), the providers may be located in other countries or territories outside the European Union.

For the proper functioning of the application, it is possible that at some point the information will be stored by our cloud service providers on servers located outside the European Union. As a user of the application, by accepting the Terms and Conditions and registering in the application, you declare that it is essential for the operation of the application, and therefore for the provision of MyOwnTree.org services, and you give express consent, so that the Personal data that you provide can be transferred and processed outside the European Union.

As a User, you guarantee that the personal data provided is true and accurate and you agree to notify us of any changes or modifications thereof. Any damage or loss caused to the site or to the person responsible for the website and/ or application or to any third party through the communication of erroneous, inaccurate or incomplete information through the application at the time of registration, when making inquiries or when contracting products, or additional services within the application will be the sole responsibility of the User.

 

GDPR rights

As a User, you can freely exercise your rights of Access, Rectification and Forgotten ('GDPR Rights') in the legally foreseen terms. You must send an email to the following address: contact[at]myowntree.org, indicating in both cases your first name, last name and email address. You can also send a written letter to our postal address. In any case, do not hesitate to send any questions or comments about privacy to this email address, we will be happy to answer your questions.

 

Transfer of data to third parties

MyOwnTree.org does not transmit the personal data of its Users to third parties, except as stated in the Terms and Conditions, unless the User has previously given their express authorization or there is a legal obligation to transfer the data.

In the case of payment processing, the data required for the transactions are transmitted to the payment gateway, provided that the Users have not communicated directly to them. In the case that you transmit your data directly to the payment gateway, we will only receive restricted data. In this case, we will only be informed if the transaction has been carried out or not, with a certain transaction ID. We do not receive your bank account information.

In the case of a violation of rights of third parties (especially copyrights, trademarks, name and brand rights) by the User, only the User's data will be provided to the right holder if the rights claims are directed by MyOwnTree NGO.

 

Legal age

MyOwnTree.org is primarily intended for users of legal age. Use of the application by minors is not allowed without the consent of their legal guardian. Therefore, MyOwnTree.org reserves the right to erase all data related to minors if there is no permission granted by their legal guardians.

 

Cookies and other technologies policy

In compliance with GDPR, we inform you that the application will only use storage and data recovery devices ('Cookies') when the user has given his consent for this, according to what is indicated in the pop-up window of the user's application when he first accesses the application, and in the Terms and Conditions that every user must be familiar with.

Our Cookies Policy aims to help understand how we use cookies, the purpose of the cookies used, as well as the possible options that the user has to manage them. The published policy is subject to periodic updates. Users can access this information at any time through the link 'Privacy Policies' enabled in the application. What are my options?

It is possible to perform the following actions:

- Accept cookies: You will not see the warning again when accessing any page.

- Do nothing: The warning will always be displayed when accessing any page of the application. If you continue browsing, we consider that you accept the use of cookies.

- Modify the configuration of the cookies: You can delete the cookies of the application and modify the configuration of your device. But this will not prevent the warning of cookies from being displayed when you access the application again.

 

What is a cookie?
